I've had my braces off since the end of April this year. I have always been a night time clencher and have always had a clicky jaw. When I first got my Essix retainer (only an upper one, I have 2 bonded retainers though) because it was so new I couldn't bite down on my right side as the clear part that goes on the roof of my mouth felt too low compared to the left. A few days after I noticed an indent in it from the pressure of my bottom teeth. Now there is a small crack. I go to the orthodontist in two weeks.
Would this be considered my fault? Do you think they would give me a replacement?
I don't like the design and would much rather a Hawley retainer but they don't have them for some reason. They make the Essix ones on site.

I don't think they'll regard this as your fault, since the retainer is so new. Maybe they can make the next one out of thicker material.
You may not have been issued a Hawley because it would be inappropriate for your case; each retainer type handles different loads. (I was issued both; the Essix for social occasions when I was still on 24 hr wear. Since I work from home, I rarely wore it, as I preferred the Hawley; it let my teeth "settle" a little bit so my bite was more natural.)
