Hey Pursue--First--have you talked with your ortho or the office manager? Is it just the assistant? If so, request that you have another assistant and not that one again. After about 4 miserable months, I did that. I can't even stand the site of the original assistant, but the one I have now is absolutely wonderful!

You need to express your concerns as fully as possible-and perhaps take a witness. Maybe even put it all in writing. If you let them know where you're at--100% where you're at--you may get unexpected positive results, if you are fully open and honest. It worked that way for me anyway..

I wouldn't even consider suing unless I had tried EVERY other avenue--suing is expensive and often not successful.

The treatment was already done a little more than a year ago but I got narrow sharp jaws, shaky front teeth, and front teeth contacting problem as a result of it, and probably an early stage of the TMJ condition.

I went to another orthodontist with whom I have appointments currently, who practices the RWISO philosophy. Someone recommend them because they (RWISO) don't let the front teeth touch which made sense to me. The Ortho said I have jaw joints problem and i hae to wear "splint" (mouthguard-looking) to stabilize the jaw joints.

But right now I don't think my ortho is doing a good job with the splint approach. she's asking me if I'm wearing it all the time like she asked me to, which I did. She asked because the longer I wear during the day, the less adjustment they have to do to the splint (shaving it to stabilize the pressure between the teeth I guess)

The whole process can take as little as four months but it's been longer than that and not much progress has been made. They take a lot of time to shave the splint, and now it's to the point where the backside where the molar touches is so thinned out that after eating with the splints on (as i was told to) after the last appointment a few weeks ago, holes were made in the farthest back molar groove, and now it's about 1/3 to 1/4 the size of the whole groove.

I'm not sure what I should do now. Quit this ortho and go to another RWISO ortho?

You can't really sue someone because your unhappy with the outcome, unless something specifically promised was not delivered. I wouldn't think an orthodontist would promise anything specific other than "your smile will look great" - and such a promise is unenforceable because its a subjective standard (assuming your result isn't something extremely bad).

Unless you have been damaged in some way that resulted from something done outside the normal standard of care - you don't really have a case.

My smile doesn't look great. I feel that the braces have pulled up my lower front teeth so that not only is it wobbly but the gum is showing, and the upper teeth also have been pulled down by the rubber bands and when I smile the gum shows a lot and looks hideous.

Unfortunately the models of the teeth doesn't cover the whole of the mouth (it doesn't measure the length of the upper and lower set of teeth starting from the very top of the mouth and the bottom, respectively. If the model could have caught these measurements I would have been able to know exactly how much my upper teeth sank and how much my lower front teeth rose.
