I don't know what to do....

#1 Post by asian6859 »

I had invisalign treatment before, finished 30 aligners of 41 in Hawaii 2 yrs ago, and I needed to move to WA in the middle of my treatment last year. I was going to continued the invisalign treatment by the new orthodontics in my area, but he strongly suggested me to swich to metal braces because my lower teeth became worse. So I decided to switch to metal braces, even though I hate that look!
In this case, is there any possibility that I get some money back from my ex-ortho? The biggest problem is, I have been trying to contact my ex-ortho by e-mailing and calling but they never respond me!!! Everytime I call them, they are like " Sorry doctor is out of town, we will contact you later..." then never called me. I don't know what to do....Please give me some advises.
Thanks.

You might be able to get some money back but the fact that was two years ago is a problem. I would try to find your original contract and see if it takes about switching orthos. Also see how it words your treatment. Does it say you were going to be treated for x number of aligners or for x amount of time. Given that the old ortho's office is giving you the run-around call them again and tell them that since you have tried multiple times to talk to them about this and they are basically refusing (by never calling you back) you are going to have to seek outside help. Worked like a charm with my old ortho. Good luck!

thanks for your response, invisagirl.
I have a copy of contract here, and it says that the account will be adjusted and a just settlement determinded, based on the amount of treatment completed if services are terminated, but 1/3 of the treatment fee is incurred at the time of initial placement of aligners...
So I don't know how much the adjustment would be, but I would like to know how they estimate at least....

I will try to talk to them anyway.
Again thanks for your advice. :D

I suggest you make a copy of your contract, highlight the part you just posted here and send that copy in a "return receipt requestion" envelope to your old orthodontist. This will give you documentation if you need to take further action. OH ya, also be sure to inform them in that letter that you will be taking further action within 10 days of receipt.

When you recieve confirmation of the receipt of the letter, give it about 5 days then contact them by phone (be sure you record the date of every phone call as well). If they continue to ignore you, file a claim in small claims court (depending on your specific state laws) If it is enough money to worry about.

Good luck!!!
